TERMS AND CONDITIONS 2026

  1. Acceptance of the quotation (fixed cost or estimate) which will be clearly stated) signifies that the customer has understood the following terms and conditions.

  2. Quotes are valid for 30 days from the issuing date.

  3. The customer must make sure they have obtained all permissions, given all notices, and paid all fees required under any regulation or bylaw of any local authority/statutory undertaker/other authority, having jurisdiction with regard to the services. The customer agrees to hold Bobby Brown Garden Construction unaccountable from any claim, litigation, loss, or expense incurred as a result of the customer’s failure to obtain permissions, give notices, or pay fees as necessary, in total or in part.

  4. Before the work can begin, all contracts must be confirmed in writing, this includes confirmation by email. However, the confirmation needs to include the quote number, the date, and a signed and printed statement of acceptance of the terms and conditions herein.

  5. Cancellations are required 14 days prior to start date in writing. Materials already purchased specifically for the works are chargeable to the Customer.

  6. Upon agreement and signing of the contract we ask for a deposit of 50% of the total agreed amount for the services to proceed, with the remaining balance of 50% to be paid once the services in the agreed contract have been completed by Bobby Brown Garden Construction. Any additional charges that have been agreed-upon that were outside of the original contract will be invoiced in the same invoice as the final remaining 50% payment.

  7. Unless agreed in writing, no liability can be accepted for revisions to the services as shown in the contract, unless agreed in writing.

  8. No liability can be accepted for the faults in the services provided when following plans/drawings from external sources/companies.

  9. Any additional services carried out on the customer’s request that is not stated in the contract will incur a fee. Before any additional work is started, a quotation will be provided must be quoted and agreed upon in writing.

  10. The Contractor will be reimbursed from time to time for reasonable and necessary expenses incurred by the Contractor in connection with providing the Services. All expenses must be pre-approved by the Customer.

  11. The customer must provide suitable access to the site e.g., all vehicles and other obstructions must be removed, any gates, doorways and pathways must be unlocked and clear, and neighbours must be notified where access is needed to proceed with the work. We also please ask that all animal waste is cleared from the job site. The team may leave the site if these requirements are not met, and the customer may still be charged.

  12. The customer must provide parking permits or parking expenses for all vehicles visiting the job site in relation to the services within the contract where and when necessary.

  13. Bobby Brown Garden Construction will retain a lien on all materials and goods left on site until all invoices have been paid in full.

  14. All quotations are provided on the assumption that existing ground conditions are suitable for the proposed works and that the minimum structural requirements for foundations, sub-bases, drainage, and other supporting elements can be achieved using standard construction methods.

    As ground conditions cannot be fully assessed until excavation has commenced, all quotations relating to excavation works are subject to revision. If, during excavation, Bobby Brown Garden Construction Ltd discovers unforeseen ground conditions, including but not limited to wet or high-plasticity clay, peat or organic soils, silt, fine alluvial soils, uncompacted made ground or fill, a high water table, or waterlogged ground, additional works may be required to ensure the installation is structurally sound and fit for purpose.

    In such circumstances, Bobby Brown Garden Construction Ltd will promptly notify the Customer, explain the nature of the unforeseen conditions, and provide a revised quotation for any additional works required. No additional work outside the original quotation will be undertaken without the Customer's approval, except where immediate action is reasonably necessary to make the site safe or prevent damage.

    Any additional works will be carried out in accordance with recognised good building practice to ensure the completed works are appropriate for the site conditions and achieve the required structural standard.

  15. Any issues or objections should be communicated to Bobby Brown Garden Construction within seven days after the completion of the job agreed in the contract.

  16. Bobby Brown Garden Construction is not responsible for any damage to the work carried out in relation to the contract cause by extreme weather such as, summer drought, damage from tree, shrub and other plant roots, water shortages, frost, and landslides.

  17. Bobby Brown Garden Construction cannot be held liable for damage to local statutory utilities such as gas, electrical lines, water, and drainage as knowledge of their locations should be given prior to the work beginning.

  18. Invoices for completed work that are not paid within 14 days will be subject to a 5% monthly interest fee on all outstanding amounts. Additionally, an administrative fee of £30.00 will be applied to each following invoice. Bobby Brown Garden Construction have the right to enforce charges for late payment in agreement with our terms and conditions when agreeing to and signing the contract.

  19. Bobby Brown Garden Construction Ltd warrants that all works will be carried out with reasonable skill, care, and in accordance with recognised good landscaping and construction practices. Subject to these Terms and Conditions, Bobby Brown Garden Construction Ltd will rectify any defects arising from faulty workmanship that are reported within 24 months of practical completion.

    After the expiry of the 24-month defects liability period, Bobby Brown Garden Construction Ltd shall have no further liability for defects, deterioration, movement, settlement, cracking, or other issues affecting the completed works, except where liability cannot be excluded by law.

    The Customer acknowledges that landscaping and external construction are exposed to natural and environmental factors beyond the Contractor's control, including but not limited to ground movement, shrinkage or expansion of clay soils, settlement, tree root activity, weather conditions, flooding, drought, frost, changes in groundwater levels, and normal wear and tear. Such factors may affect the appearance or performance of the works over time and shall not constitute defects in workmanship or materials.
